Florida Chapter 7 Bankruptcy Attorney

Chapter 7 bankruptcy, also referred to as liquidation, is the most popular form of bankruptcy as it completely erases most of your unsecured debt, giving you the fresh start you need after spending many years with mounting debt.

Not all debts can be discharged through Chapter 7 bankruptcy. The types of debt that cannot be discharged include:

  • Child support
  • Alimony
  • Taxes
  • Student loans
  • Restitution to victims of personal injury accidents
  • DUI debts

Because a debtor’s assets will be used to pay off his or her debts, many people who file for Chapter 7 bankruptcy fear they will lose their assets and property. However, under Florida law, certain property and assets are exempt from seizure, such as home equity, up to $1,000 of equity in your personal property, and up to $1,000 of equity in your car. In reality, most people who file for Chapter 7 bankruptcy do not lose their assets or property, just their debt!

Is Chapter 7 Right for Me?

Chapter 7 bankruptcy is not suitable for everyone in Florida. Filing for bankruptcy under Chapter 7 is best for people who:

  • Are below the median income level for the size of their family
  • Have little or no assets to surrender
  • Are not behind on paying their mortgage or car payments

Once Chapter 7 has been filed, all of the negative effects of having too much debt—creditor harassment, foreclosure, eviction, repossessions, wage garnishments—will immediately cease.
